Terms of Service

These Terms of Service ("Terms") govern your access to and use of GanttCraftand any related services (collectively, the "Service"). By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using it you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Your account

You may use the editor without creating an account. To save charts, share them, or access them across devices you must sign in via Google OAuth.

You are responsible for all activity that occurs under your account. Keep your session secure and do not share access. If you believe your account has been compromised, contact us immediately.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Upload or share content that is unlawful, defamatory, obscene, or harmful
• Attempt to gain unauthorised access to any part of the Service or another user's data
• Use automated scripts to scrape, crawl, or abuse the Service at a rate that impairs its operation
• Circumvent any rate limits, download quotas, or plan restrictions
• Resell or sublicense access to the Service without our written consent

We may remove content or suspend accounts that we determine, in our sole discretion, are in violation of these rules.

5. Your content

You own the charts and data you create. By using the Service you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to operate and provide the Service to you.

You are responsible for ensuring you have the right to upload any content you add to the Service, including any text, data, or images embedded in your charts.

6. Collaboration and sharing

When you invite collaborators or enable a public link, you are choosing to share your content with those parties. You are responsible for the sharing decisions you make.

Email invitations are sent by our infrastructure on your behalf. By sending an invite you confirm you have a legitimate reason to contact the recipient and that doing so complies with applicable anti-spam laws.

7. Intellectual property

The Service, including its design, code, trademarks, and all content we create, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of it without permission. These Terms do not grant you any rights in the Service itself beyond the limited right to use it as described herein.

8. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or experience outages outside our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and, where feasible, a means to export your data.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $10 USD.

11. Indemnification

You agree to indemnify and hold harmless GanttCraft and its operators from any claim, demand, damage, or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

12. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. We will update the "last updated" date at the top of this page and, for material changes, notify you by email or an in-app notice at least 14 days before the change takes effect. Continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.
